OurNextRep – Terms and Conditions

Welcome to OurNextRep ("OurNextRep," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the OurNextRep platform (the "Platform").

By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. What OurNextRep Is

OurNextRep is an online platform that helps athletes, parents or guardians, and organizations ("Consumers") discover, schedule, and manage sports lessons offered by independent coaches, trainers, teams, or organizations ("Producers"). OurNextRep does not provide coaching services. We are a scheduling, communication, and organizational platform only.

2. Eligibility and Accounts

2.1 Age and Guardianship

  • Users must be at least 18 years old, or
  • A parent or legal guardian must create and manage an account for a minor.

By creating an account for a minor, you confirm that you are the minor's legal guardian and consent to their use of the Platform.

2.2 Account Responsibility

You are responsible for:

  • Providing accurate information
  • Maintaining the security of your account
  • All activity that occurs under your account

We may suspend or terminate accounts that violate these Terms.

3. Platform Role and Disclaimer

OurNextRep:

  • Does not employ, supervise, or certify Producers
  • Is not a party to any agreement between Consumers and Producers
  • Does not guarantee lesson quality, safety, or outcomes

All lessons and instruction are provided solely by independent Producers.

4. Lessons, Scheduling, and Cancellations

  • Lesson details, availability, and requirements are set by Producers.
  • Consumers are responsible for reviewing lesson information before booking.
  • Cancellation, rescheduling, and no-show policies are determined by Producers.

OurNextRep is not responsible for missed lessons, disputes, or refunds.

5. Physical Activity & Assumption of Risk

Participation in sports and athletic activities involves inherent risks, including injury. By using the Platform, you:

  • Acknowledge and accept these risks
  • Participate voluntarily and at your own risk
  • Agree that OurNextRep is not responsible for injuries, accidents, or damages related to lessons

Guardians are responsible for determining whether minors are physically fit to participate.

6. Payments and Fees (If Applicable)

If payment features are enabled:

  • Payments may be processed through third-party providers
  • Producers are responsible for pricing, refunds, and disputes
  • OurNextRep does not guarantee payment processing availability

We reserve the right to introduce paid features, subscriptions, or transaction fees with notice.

7. Messaging and Communication

OurNextRep may provide messaging tools for lesson-related communication. You agree not to use messaging features to:

  • Harass, threaten, or abuse others
  • Send spam or unsolicited promotions
  • Share illegal or inappropriate content

We may monitor, moderate, or restrict messaging to maintain safety and integrity.

8. Acceptable Use

You agree not to:

  • Misuse or disrupt the Platform
  • Attempt to bypass safeguards or usage limits
  • Abuse AI features or system resources
  • Scrape, reverse-engineer, or copy the Platform
  • Impersonate others or provide false information

Violations may result in account suspension or termination.

9. AI Features

OurNextRep may include AI-powered features to assist with search, content generation, or data entry. You acknowledge that:

  • AI output may be inaccurate or incomplete
  • AI features are provided for assistance only
  • You are responsible for verifying any information before relying on it

We may limit or restrict AI usage at our discretion.

10. User Content

You retain ownership of content you submit to the Platform. By submitting content, you grant OurNextRep a non-exclusive, royalty-free license to use, display, and store it solely to operate the Platform. You are responsible for ensuring your content complies with applicable laws and does not violate third-party rights.

11. Intellectual Property

All Platform software, branding, and design (excluding user content) are owned by OurNextRep and protected by intellectual property laws. You may not copy, modify, or distribute Platform content without permission.

12. Privacy

Your use of the Platform is subject to our Privacy Policy, which explains how we collect and use personal data.

13. Termination

We may suspend or terminate access to the Platform for violations of these Terms or misuse of the Platform. You may stop using the Platform at any time.

14. Disclaimers

The Platform is provided "as is" and "as available." We make no warranties regarding:

  • Platform availability or uptime
  • Lesson quality or outcomes
  • Accuracy of user-provided or AI-generated content

15. Limitation of Liability

To the fullest extent permitted by law, OurNextRep is not liable for:

  • Injuries or damages arising from lessons or athletic activities
  • Disputes between Consumers and Producers
  • Loss of data, revenue, or opportunities

Our total liability will not exceed the amount paid to OurNextRep (if any) in the prior 12 months.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles.
